Disposition: Despite being indicted as the Number 2 player in the hierarchy for Enterprise (Gambling) Corruption – a B felony carrying mandatory upstate jail time- and facing thousands of hours of conversations gleaned through wiretapping (electronic eavesdropping), surveillance and physical and computer evidence obtained during the three year investigation, the defense was able to negotiate (after over a full year of litigation) a misdemeanor plea with restitution, forfeiture of moneys recovered and a Conditional Discharge (no jail).
