Criminal Defense Lawyer, Queens New York

With over 40 years of experience, Victor Knapp has been representing the residents of New York in connection with investigations, arrests and allegations of criminal misconduct.

The criminal laws in New York are dynamic and constantly changing. Often, criminal charges come at the worst time and can be financially, emotionally, and mentally challenging.

The outcome of your criminal case can have lifelong consequences for you and your loved ones. Having an experienced criminal defense attorney by your side is essential to obtain the best result and outcome available.

A criminal conviction can not only possibly result in a substantial jail sentence but also can have collateral consequences that can last a lifetime. Relying upon fate, lack of defense preparation or the possibility of incorrect advice can be devastating.

Victor Knapp will aggressively fight for his client’s rights. With 40 years of experience successfully defending clients from all walks of life charged with crimes (ranging from very serious to minor), he is well familiar with all the players and strategies involved in the defense, prosecution and adjudication of cases, and is able to effectively develop successful defense strategies quickly when it is needed the most.

The most effective defense of potential criminal charges starts before an arrest is even made. Whether it be the gathering of favorable evidence or intervening with law enforcement authorities, an arrest can sometimes avoided completely. Even if an arrest is inevitable, early representation by experienced counsel can make the arrest and arraignment process less disturbing and run more smoothly.

If an arrest has already been made and criminal charges already filed, Victor Knapp can investigate and gather all favorable evidence and challenge the prosecution’s case by intensive discovery review and motions to suppress any evidence improperly obtained by the police or other law enforcement agents. Victor Knapp is an experienced criminal defense attorney who is not afraid to go to trial to obtain a “not guilty” verdict.

If you, a friend or a loved one is being investigated or has been charged with a crime, it is essential that you take immediate action to obtain an experienced criminal defense attorney who is available and proactive. Possible jail is not the only negative consequence of a criminal conviction. With over four decades of experience, criminal defense attorney Victor Knapp aggressively represents men and women who are being investigated for criminal activity and/or have been charged with crimes in Queens, Long Island, Westchester and throughout the five boroughs of New York City.

The Law Office of Victor Knapp is committed to being the right Criminal Defense Lawyer serving Queens, New York and all 5 boroughs.  We take pride in our success in representing matters the following areas and beyond.

  • Domestic Violence – Domestic violence cases can have serious immediate consequences including the possibility of bail being set to obtain release from custody and the issuance of a full order of protection requiring you to actually leave your residence and have no contact whatsoever with the family members or intimate partner involved. Often, arrests are made by the police upon mere accusations without any proof to corroborate them.
  • Weapons / Gun / Firearm Charges – Weapon charges can include the possession and/or use of firearms, stun guns, knives, brass knuckles or any other dangerous instrument with the intent to use unlawfully. Mere possession of a loaded firearm outside the home constitutes a Class “C” violent felony carrying a potential minimum upstate jail sentence of 3.5 years even for a first offender. The services of an experienced criminal defense attorney to litigate weapons cases is essential.
  • Driving While Intoxicated or Impaired (DWI) – Arrests for violations of New York Vehicle and Traffic Law § 1192 have immediate negative consequences and potentially long-term repercussions. License suspensions / revocations, possible jail, probation with strict conditions, automobile forfeitures, ignition interlock requirements, substantial fines and surcharges are all possible negative sanctions if convicted. An experienced DWI attorney is essential to challenge and defend against these charges. An individual can be charged with a first driving while intoxicated (DWI) in New York if they operate a motor vehicle while intoxicated under New York Vehicle and Traffic Laws § 1192(3).
  • Drug Charges – Despite some relatively recent revision of the sentencing laws pertaining to drug charges, the penalties for a drug conviction can still be severe and cause future negative consequences. An experienced drug lawyer can navigate the strategies involved in defending drug charges which might include challenging credibility of law enforcement agents, the issuance of search warrants and eavesdropping warrants, developing entrapment or agency defenses, etc.
  • Juvenile Offenses – Revisions to New York law (Raise The Age legislation) have redefined the categories for the prosecution of young offenders in both the Criminal and Family Courts. Key factors are the age of the offender and whether the charges involve violent offenses. Juvenile Offenders and Adolescent Offenders charged with violent felonies generally will remain in the Criminal Courts unless a successful application for removal to the Family Court (to be prosecuted as a juvenile delinquent) is made. “Youthful Offender” treatment might be available to replace any possible criminal conviction that would otherwise possibly occur.
  • White Collar Crimes – The term “white collar crime” can include a variety of offenses such as mail and wire fraud, embezzlement, Civil RICO (criminal organizations and schemes), forgery, false filings, insurance fraud, health care fraud and many other offenses. White collar crimes can be prosecuted on both the federal (U.S. Attorney Office) and state (N.Y.S. Attorney General or local District Attorney Office) level. Many such prosecutions start with investigations by state or federal agencies.
  • Post-Conviction Remedies – These can involve post-verdict applications to set aside the verdict; post-sentence 440 applications to set aside the conviction; direct appeals; Sealing applications for qualified convictions and applications for Certificates of Relief from Civil Disabilities.
  • Parole Release and Parole Revocations – Substantial revisions in the regulations governing eligibility for parole release and parole violations / revocation has occurred over the past year. The issuance of a parole warrant may no longer require remand (no bail) status for technical violations or certain arrests. Recognizance hearings may even be available in the Criminal courts
  • Violation of Probation / Termination Applications – If one is found guilty of violating probation, he/she could be resentenced to jail. An alleged probation violator is entitled to a hearing to challenge the probation violation specifications and / or offer mitigation. Conversely, a probationer who has served one-half the probation term and has complied with all required conditions of probation, may apply for the termination of probation pursuant to C.P.L. Section 410.90. Both the defense of a violation of probation and an application for early discharge of parole should be handled by experienced counsel familiar with law, underlying facts and the arena that such matters will be litigated.
