The BAC (Blood Alcohol Content) threshold for DWI (Driving While Intoxicated) charges is 0.08%. It should be noted that this limit drops to just 0.04% for commercial drivers, who are often transporting large or hazardous loads.

The BAC for determining DWAI (Driving While Ability Impaired) is slightly lower, categorized as less than 0.07% but greater than 0.05%.

Of course, BAC cannot be utilized where drugged driving is suspected. In cases involving narcotics, other forms of chemical testing (e.g. urine testing or blood testing) may be used, in addition to the testimony of a trained DRE (Drug Recognition Expert) officer. Obvious signs of drug use, such as visible paraphernalia in the vehicle, will also be considered.
